Evolution of legal understanding in Western philosophy

The article is devoted to the analysis of research approaches legal understanding in Western philosophy, starting from ancient Greek period and ending with second half 20th century. aim work form a comprehensive historically changing types comprehending law (including, such areas as naturalism, moralism, traditionalism, normativism, positivism, sociologism, realism) revealed three aspects: formation factors, essence criticism. was carried out within framework modern scientific paradigm, which implies taking into account plurality, complementarity interdisciplinarity study surrounding world. In context evolution methodology, attention drawn conditions diversity, «heredity» «mutation» existing existed philosophical views regarding nature law. As result positions thinkers Plato, Aristotle, Cicero, Thomas Aquinas, Grotius, Suarez, Pufendorf, Coke, Hale, Blackstone, Hobbes, Bentham, Kant, Austin, Kelsen, Hart, Raz, Dworkin, Fennis, Ross, Llewellyn, an attempt made demonstrate reflection on factorial transformation social state reality, contributes “stitching matter” ideas about reality. area implication correlates range interests scientists professional subjects political sphere interested objectifying knowledge traditional foundations European understanding, manifest themselves enforcement practice. It can be concluded that emergence philosophy paradigms, signifies “adaptation” challenges era, will ultimately determine how institutions understood developed future.
